Constitutional Court Cannot Accept PAP’s Application for Proceedings

Member of Parliament Mane Tandilyan, Bright Armenia Party, posted on Facebook, commenting on the statement of PAP about sending an application to the Constitutional Court.

“We are often asked if members of parliament can apply to the Constitutional Court with 26 signatures.

Note that according to Article 169 Para 1.2 of the Constitution, at least 1/5 of the members of parliament or at least 20% can apply to the Constitutional Court.

26 members of parliament comprise 19.7% which is definitely less than 20%, 1/5. Hence, the Constitutional Court has no right to accept the application for proceedings, as ever.”

Earlier the secretary of Prosperous Armenia parliamentary group Arman Abovyan posted a screenshot of an online application to the Constitutional Court on behalf of Prosperous Armenia Party and wrote: “Dear compatriots, as secretary of the PAP parliamentary group, I would like to inform you that my colleagues in Prosperous Armenia parliamentary group, myself and independent MP Tigran Urikhanyan sent to the Constitutional Court the application addressed to the Constitutional Court.”

PAP is disputing the constitutional amendments adopted by the National Assembly.
